Oppose Constitutional Amendment Ending Cash Bail in Delaware



The Delaware Legislature is signaling citizens they are to get hard on crime by denying bail by proposing a constitutional amendment to allow persons to deny bail to a variety of violent defendants. 

Unfortunately, however, Senate Bill 12, the implementation portion of that legislation, will make it nearly impossible for the judges to set bail, which a defendant would be required to post and thus have an incentive to go to court and answer for the charges.

Prosecutors will be left with filing as many motions to deny bail as they can, knowing if they lose the motion, the defendant will walk out for free with no accountability, increasing failures to appear in court and long-term fugitive rates (which typically involves long-term crime committing behavior).
