There are a myriad of reasons as to why this law regarding bail does not work. However, as a practicing criminal defense attorney I believe that many released without bail defendants will have little incentive to appear in court once they are offered a sentence that includes serving jail time. I witnessed this on one of my cases today. The policy as currently written does not take into consideration a person’s prior record or failure to appear record. Judge’s must have the discretion to set bail. This 3rd option of partially secured bail is a farce. A bondsman has several roles that assist the court process. First, they remind defendants of court. They also have an incentive to apprehend a defendant if they miss court (we are going to have countless police hours working to find those defendants who warranted as opposed to policing our streets). The bondsman also signifies a financial stake of the defendants family that incentivizes the defendant to appear. I agree that most misdemeanors shall have CRP or ROR but this is far too overreaching and broad. We will see mass failures to appear in court and reoffend. We also have not heard much about the publics perception from those who commit crimes that believe that this new law “never” will incarcerate them on the enumerated crimes that have no bail.
Stop this stupid law. Now both the NYC mayor and NY governor need to be personally and Financially held accountable for anything and everything these people do when they’re released. Hold them both to The WALL ??
